The mediation process is structured to enable the parties to play the principal role themselves, often with the support of their professional advisers. The benefits of this approach are much the same as those for conciliation: commercial relationships are better preserved and protected, and time and money are saved.

without prejudice, subject to contract and privileged

confidential to each of the parties and to the mediators to the extent agreed by the parties

|
a consensual process that depends on co-operation from the parties and their continuing willingness to mediate

not binding but is intended to lead to a binding agreement
