arbitration

Arbitration brings about a binding determination in settlement of a dispute that unlike other dispute resolution techniques is enforceable in the same way as a court judgment. It is a more formal process although less adversarial than court proceedings.

Arbitration is:
  • conducted by an individual arbitrator or arbitration panel
  • a binding technique – the arbitrator or arbitration team must reach a decision in accordance with the Arbitration Act 1996 for England and Wales
  • a more formal process although CDP arbitration is designed to be flexible and less confrontational than some traditional arbitration
